Yesterday, Alicia Maxey Greene, a spokeswoman for the Manhattan District Attorney, announced that he's getting away with it:

On May 5, during an afterparty for the Costume Institute Gala in New York, Kiefer Sutherland headbutted designer Jack McCollough after he supposedly knocked over Brooke Shields. Yesterday, Alicia Maxey Greene, a spokeswoman for the Manhattan District Attorney, announced that he's getting away with it:
"We declined to prosecute after a full investigation. That included speaking to the complaining witness, who was quite uncooperative."This is probably a smart move by the Manhattan DA. You hate to waste resources on a case where there's only 250 witnesses. You really need video of the incident from at least three different angles and a sketch from one of those courtroom artists if you're gonna prosecute someone as famous as Kiefer. I think he's owed a huge apology and maybe a fruit basket or two for this whole inconvenience.
Sutherland, 42, is also off the hook with the L.A. City Attorney's office, which investigated the actor for a possible probation violation. Sutherland is currently serving a five-year probation term following a second DUI conviction in 2007.
